What is litigation? It's the legal process of bringing and pursuing a lawsuit—a civil action that begins when one party (the plaintiff) files papers with a court against an individual or group (defendant) for the purpose of settling a conflict or enforcing a right. Lawsuit participants (both sides) are called litigants.
If the case goes to court and the plaintiff is successful, the court may award damages, issue orders to enforce a right or impose a permanent or temporary injunction to stop or compel action by the defendant.
Bringing a case to court is time-consuming and expensive for all parties. If the lawsuit does go to trial, it may be followed by a lengthy and costly appeal. More than 90 percent of all U.S. lawsuits are resolved before they go to trial. When it's in your best interest, we will encourage settlement with mediation or arbitration.
